Norfolk, Va.- Court documents for 22-year-old Dominique Chapman show that no firearm was allegedly used by him the night he was shot by Norfolk police.

On the bail determination checklist Magistrate David Vitto marked "No,"  following the question, "was a firearm allegedly used in the offense."

Chapman spoke only to NewsChannel 3, and says that he did have a gun but never pulled it out. He says the gun fell out while he was running.

"I never threatened the officer for him to even start pulling his gun out on me," said Chapman.

Arrest warrants show he is charged with carrying a concealed weapon and altering a serial number.

NewsChannel 3 reached out to the Magistrate's office to ask about the document, but no one could answer our questions.

Norfolk police have also refused to address what exactly led to the shooting and how Chapman threatened the responding officers.

Chapman was scheduled for a bond hearing Wednesday morning, but it was continued since a special prosecutor from Virginia Beach could not make it.
