Nags Head police chief back at work despite assault charge

Nags Head, N.C.- The town's chief of police is back on the job after he was charged with assaulting his wife.

The chief had been on paid administrative leave following the November 28 incident. The town manager, Cliff Ogburn, said he reviewed police documents and interviewed several people before deciding to let the chief come back.

"This is a personal matter for him and his family. This was not an incident where he was on the job," said Ogburn.

According to warrants, Brinkley grabbed his wife Rochelle's neck twice. She hit him twice with her first and hit him in the hand with a statue, according to the warrant. She is also charged with misdemeanor simple assault.

"For one, I don't know how long it will take for the court system to resolve [the case]. I truly believe we should consider people to be innocent until proven guilty," said Ogburn.

Both Brinkley and his wife are due in court on January 26.
