Portsmouth Police say a driver tried to beat a train, but ended up being hit. That driver has been charged with failure to yield.

The crash happened just after 10:30 p.m. on Sunday night, on Frederick Boulevard off Interstate 264.

That railroad crossing does not have guards, but has flashing lights and sound.

Drivers say

The train was a CSX engine, and it was not carrying a load.

The CSX conductor of the train told police that several people tried to beat the train, even though lights were flashing and the warning alarm was going off.

The driver of the SUV that was hit told police he was trying to beat the train.

According to Detective Holley, the driver was in the car with his son, who is under the age of 12.

The man and a child inside the SUV were both taken to the hospital.

Both are expected to recover.
