After charges dropped, ODU student indicted for rape, sodomy, and conspiracy

Norfolk, Va. - Jack Ly, an ODU student, was relieved in December after a Norfolk judge dismissed charges connected to the rape of two women last summer.

Now court documents obtained by NewsChannel 3 reveal Ly has since been indicted for rape, sodomy, and conspiracy.

Former ODU football players Reid Evans and Markell Wilkins are fighting charges stemming from the same incident.

During the preliminary hearing in December, two 18-year-old women testified that Ly and Evans raped them inside Evan's dorm room last summer.

They said it happened after the girls met Ly and Evans at the Oceanfront and went back to the ODU campus.

The women said they became incoherent after drinking several shots of vodka Evans and Ly poured for them, and said they felt incapable of saying no or pushing the men off.

After the December preliminary hearing, rape charges against Evans and conspiracy charges against Wilkins went forward.  Charges against Ly were dropped.

Now NewsChannel 3 has learned that months later, not only was Ly indicted in the incident, but Wilkins faced an additional indictment for sodomy and Evans faced another indictment for sodomy and conspiracy to commit rape.

All of the men have maintained their innocence.

NewsChannel 3’s Jessica Larche spoke with Ly's attorney.

He said the indictments are ridiculous and he and Ly are ready for trial.

The trial for all three men is set for next week, but officials say it will likely be continued.
