Beau Norton, 35, was taken into custody without incident on Thursday, Dec. 1 in connection with the Nov. 13 incident at Filiberto’s at 13972 N. 83rd Ave. in Peoria.

Police said Norton passed through the drive-thru and ordered some steak ranchero. About five minutes later, he returned, parked his pickup truck, walked up to the drive-thru window and confronted an employee, claiming his order was incorrect, court paperwork stated.

The manager, who is half black and half Hispanic, appeared at the window and said he would fix the order and walk it out to him.

When he went to deliver the re-made food, he told Norton he would never be welcomed back at the restaurant, police said.

Norton alleged began yelling at the manager, hurling racial slurs. Norton walked back to his vehicle, grabbed a weapon, racked the side of his handgun and pointed it 3 or 4 inches from the manager’s nose, the court document stated.

“I should shoot you where you stand,” Norton allegedly told the manager.

Norton then threw the food all over the parking lot and drove away, according to the probable cause statement.

The manager saw Norton’s license plate and remembered it, police said. He also alleged Norton appeared intoxicated.

Several minutes later, Norton called the restaurant and spoke to the manager, who jotted down Norton’s phone number.

During a photo lineup, the manager and the restaurant employee were able to identify Norton as the man who had confronted them. The phone was the same as the number given to a Department of Public Safety trooper on Sept.28 during a traffic citation. Police said during the traffic stop, Norton was driving the same vehicle.

On June 18, 2011, Norton was involved in an incident just a few hundred yards from Filiberto’s. During the incident, police said Norton retrieved a handgun from his vehicle, racked the slide and pointed it at several people on the patio of the bar and allegedly asked, “Who was laughing at me?”

Norton was arrested for disorderly conduct in connection with the 2011 incident.

During his most recent arrest last week, officers obtained a search warrant and discovered a black semi-automatic handgun in his truck.

Norton was booked into jail on one count of aggravated assault with a deadly weapon.
