A judge says he won't postpone a hearing for Ab al-Rahim al-Nashiri over allegations of government eavesdropping according to the Miami Herald.

Al-nashiri is accused of planning the 2000 bombing on the USS Cole that killed 17 sailors.

The Herald reports Nashiri's lawyer wants to investigate whether the CIA or another intelligence agency was listening in on confidential attorney-client conversations at Guantanamo Bay, Cuba.

Now the Herald reports the judge did consider removing some of the microphones in the court room to protect attorney-client privacy.

The preliminary hearings are expected to last four days.
