Charges dismissed against Sailor who police say assaulted Uber driver in Virginia Beach

VIRGINIA BEACH, Va. – A Navy Sailor accused of assaulting an Uber driver in Virginia Beach had his assault charge dismissed in court on Thursday after both sides came to a settlement.

Back in July, Virginia Beach Police were called to Laskin Road for a stabbing.

An Uber driver told police one of her passengers assaulted her and she stabbed him as a result.

Police say the assault happened inside the vehicle. A spokeswoman for the victim said the passengers she picked up that night were drunk and they verbally berated her using racial slurs. When she pulled over to get another ride for her passengers, that is when Nee reached through the window and punched her in the face while another passenger restrained her, according to a spokeswoman.

The driver suffered a torn rotator cuff while being restrained because the spokeswoman said she was trying to get away. She eventually used a knife to stab Nee in the arm several times to protect herself. The uber driver was also a sailor at the time of the assault, trying to earn money through Uber as a second job.

The passenger, 21-year-old Owen Nee, was taken to the hospital with serious stab wounds. In court on Thursday, his arm was still bandaged.

After the investigation was complete, police charged Nee with assault. The driver was not charged, as police say she was defending herself.

The Navy confirms Nee is a Seaman assigned to the USS Whidbey Island at Joint Expeditionary Base Little Creek-Fort Story.

In court on Thursday, both sides came to an "accord and satisfaction" agreement and the assault charge against Nee was dismissed. The spokeswoman for the victim said Nee came forward with the offer. The money will be used for pain and suffering as well as to clean and repair the vehicle which is stained with blood.
