Supreme Court halts order allowing transgender Gloucester student to use boys’ bathroom

GLOUCESTER, Va.- A divided Supreme Court agreed Wednesday to temporarily block a lower court order that had cleared the way for a transgender male high school student to use the boys' bathroom in a Gloucester public school this fall.

The ruling is a victory for the school board and a loss -- for now -- for Gavin Grimm, the student who won at the lower court level.

On June 23, a Federal District Court in Virginia ordered the Gloucester County School Board to allow Grimm to use the boys’ bathroom saying:

“Based on the evidence submitted through declarations previously proffered for the purpose of the hearing on the Preliminary Injunction, this Court, pursuant to Title IX, hereby ORDERS that Gloucester County School Board permit the plaintiff, G.G., to use the boys’ restroom at Gloucester High School until further order of this Court.”
