Virginia Beach man sentenced to 12 years for Aggravated Sexual Battery

Upchurch was sentenced Wednesday for Aggravated Sexual Battery.

VIRGINIA BEACH, Va. – According to the Commonwealth’s Attorney for the city, a 42-year-old man was sentenced Wednesday for Aggravated Sexual Battery.

Marcus Anthony Upchurch was sentenced to 20 years with eight years suspended, leaving 12 years to serve.

Upchurch must also undergo sex offender therapy, register as a sex offender, and remain on good behavior for 20 years.

He will also be on supervised probation.

Upchurch pleaded guilty in February after the Commonwealth’s evidence proved that he sexually abused a child known to him for nearly four years.

Upchurch continued the behavior until moving out of the state. When he was interviewed by police he confessed to the crime.

He has a similar conviction involving sexual abuse of a child from New Jersey.
